Sub: Intimation of deemed taking over charge as MD : Work done today to plug

Loopholes in C & I Department as already informed by me in my letter dated 27/2/07.

Yesterday I had sent an email and also fax regarding the work I am going to do in the C & I Department. I had informed you that the DPAR has been doing all these to humiliate and harass me with criminal intention as there is no rhyme or reason in transferring me thrice in less than three weeks period. In spite of it I tried to interpret my posting order positively as an opportunity created to expose corrupt practices in the various public sector enterprises and with the money so generated by plugging leakages, to revive the sick and closed companies (not just Mysore Lamps).

I had asked the C & I Department to send me the draft terms and conditions of deputation to enable me to have minimum facilities that are needed for an officer of the principal Secretary grade. I will be using those facilities to curb corrupt practices in the C &I Department to generate funds for revival of closed companies and to initiate criminal proceedings against all persons who are responsible for the bad state of the companies. But C & I Department has issued the reposting order without even informing me the terms of deputation. I had clearly indicated that posting as a full time MD is against both the Central and State Government guidelines. This deputation has been done without taking my consent and I am against it. However, for not being corrupt or for not closing eyes to corruption, the present posting by DPAR appears to be the best one for protecting the corrupt(as per DPAR) and to cause all types of maximum damages to me I have left with no choice than to repeat as I have not heard anything on the terms and conditions of deputation.

. Since the reposting order has been done after 32 days long deliberation by the C & I Department and the DPAR, I presume that all the terms and conditions suggested by me have been accepted including the need to curb corruption in C & I Department. Hence I presume my services are needed to curb corruption in C & I Department. I had also said I would be meeting the Chief Secretary and informing him about how I am going to plug leakages and generate funds for revival of closed companies. I will be starting a website calling for information and suggestions from the public and I will also be releasing press notes. Until all arrangements are made I will be working from either the Chief Secretary’s office or from the Principal Secretary, C & I office and I will be using their facilities. Please discuss this with the Chief Secretary and inform me as to whose facilities I can use immediately. As you have accepted my deputation to your department, you should be very clear on these aspects and should not direct me back to DPAR for anything. As far as I am concerned as I have been repeatedly telling this posting has been done by the DPAR with criminal intentions only and to see to it that I will not be given any work, any staff and other facilities lawfully needed for an officer of my grade. So it makes no sense for me to approach DPAR.

If I do not hear any thing from you by 11 am tomorrow, I presume you have nothing to inform me. However I am happy to inform you that I have already started working on plugging loop holes and today I collected some very useful information about how the C and I Department replaces Assets and liabilities statements filed by officials against whom complaints are lodged with the Lokayukta. I have also been informed about the bribe collected for replacements and the officers who are paid. I am waiting for a specific case. Please instruct your personal secretary to make available any information sought by me. I also met the Hon’ble Lokayukta today and offered him my services as DPAR is more bothered about protecting the corrupt than utilizing the services of an officer like me. Hon’ble lokayukta informed me that he would be happy to avail my services for taking up investigation under 15(3)

I had also requested you yesterday to send me a vehicle to my house today (28/3/07). Whenever I checked up your office today( morning, afternoon and evening - at about 7 pm), each time the information given was that you were attending assembly. As I do not have the copy of deputation order, this is to inform you that I am deemed to have assumed charge today. The actual charge I will be taking only after I am provided with the minimum facilities sought by me in my letter dated 27/2/07. I am also informing you that in the absence of any facility I cannot take up any responsibilities, unlike the officer who is presently holding it as additional charge. When I was in DPE, a circular was issued to all closed companies to prepare inventory of all moveable assets and video graph them. Further the Companies were instructed to lodge police complaint in respect of missing items. Please instruct the officer presently holding charge to keep these things ready and hand over the physical charge to any one of the officers who is going to be asked to work with me by the C & I department. If you have any work which I should be doing tomorrow, please send a vehicle and a personal secretary and a peon.
